Types of Bankruptcy
One of the most important decisions we will make is the chapter of bankruptcy you file. Not everyone will qualify for every type of bankruptcy, and one chapter’s advantages may appeal to you more than another.
If you have few to no assets and very little income, for example, Chapter 7 may be the perfect solution. Chapter 7 is called liquidation bankruptcy because your assets are sold (i.e. liquidated) to cover as much debt as possible. The court will then discharge leftover debt after liquidating your assets. Qualifying for Chapter 7 is difficult, however, as you will need to pass a means test to demonstrate your need for relief.
If your income is too high for Chapter 7, or you have a home, vehicle, or other valuable asset you want to keep, you may consider Chapter 13. Chapter 13 is a form of debt restructuring, in which the court establishes a 3-5-year repayment plan. This chapter is best for those who have the means to pay their creditors in a reasonable amount of time.
We also assist New York taxi drivers who have suffered due to the rise of rideshare apps. We understand the struggle you may be facing in today’s competitive and rapidly changing market, and we can help you find the bankruptcy solution you need.
Other Bankruptcy Issues We Can Help With
If you owe creditors a significant amount of money, you may be enduring their endless collection attempts. Credit card debt collection can be extraordinarily difficult to withstand, especially if your creditors resort to extreme measures. They may obtain a court order, for example, to place a levy on your bank account.
These collection attempts may even cross the line into creditor harassment. At the Law Office of Seni Popat, we can help you understand your rights as a debtor and determine the best possible method of ending these collection attempts, preserving your access to your funds, and even delaying or preventing serious consequences like foreclosure.
