How Bankruptcy Can Help You
Bankruptcy is a legal process that provides court-ordered relief from qualifying debts. The exact process, timeline, and requirements depend on the chapter you file.
Our New York bankruptcy attorney can help you file:
- Chapter 7 bankruptcy. Chapter 7 typically takes less than six months. The trustee may use your assets to repay creditors, but most people who file Chapter 7 can protect everything they own from this liquidation process by claiming state or federal bankruptcy exemptions. Chapter 7 is the most common type of bankruptcy filed by consumers in the United States. To qualify, you generally must make less than the median income in your state for a household the same size as yours. However, there are some exceptions to this threshold.
- Chapter 13 bankruptcy. Chapter 13 is a much longer process. For 3-5 years, you will make monthly payments toward your debt, and the trustee will collect the payments and distribute the funds to your creditors. It does not involve a liquidation process, but you will need to pay the value of your nonexempt property over the course of your plan. Under certain circumstances, you may benefit from a vehicle loan cramdown and/or second mortgage lien-stripping. There is no income limit for Chapter 13, but you must owe less than $419,275 in unsecured debt and $1,257,850 in secured debt.
No matter which chapter you file, your petition will trigger a court order called the automatic stay. This order protects you from all types of debt collection tactics for the duration of your case. As such, you will be free from calls, letters, lawsuits, wage garnishment, foreclosure, repossession, and more.
Once your case is complete, the court will discharge qualifying debts. When a debt is discharged, the borrower is no longer liable for it, and the creditor or debt collector is no longer allowed to pursue it. This elimination of debt is permanent. You can receive a debt discharge after either Chapter 7 or Chapter 13.
Through bankruptcy, you may be able to wipe out debts such as:
- Medical bills
- Credit card debt
- Unsecured personal loans (e.g. “payday loans”)
- Unpaid utility bills
- Old income taxes (in certain cases)
- Student loans (in rare cases)
Bankruptcy can also eliminate your liability for mortgage debt and automobile loans, but that may not mean you are safe from foreclosure or repossession.
